PLEASE READ CAREFULLY. By accessing coverlandbrokerage.com (the “Site”) or any services, tools, calculators, content, or SMS programs offered by CoverLand Brokerage, Inc. (“CoverLand Brokerage,” “CoverLand,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.

1. INTRODUCTION  

These Terms constitute a legally binding agreement between you and CoverLand Brokerage governing your access to and use of the Site, our mobile content, and any related communications or services (collectively, the “Services”).

2. DEFINITIONS  

• “Content” – text, graphics, software, photos, videos, data, and other materials on the Site.  

• “User,” “you,” or “your” – any person or entity that visits, browses, inputs information, or otherwise uses the Site or Services.

3. ACCEPTANCE OF TERMS  

Using the Site in any manner signifies your consent to these Terms, our Privacy Policy, and our Messaging Terms & Conditions (collectively, the “Agreement”), all incorporated herein by reference.

4. MODIFICATIONS  

We may update the Agreement at any time. Revised versions take effect when posted with an updated “Last Revised” date. Your continued use after changes constitutes acceptance of those changes.

5. ELIGIBILITY & AGE REQUIREMENT  

The Site is intended for U.S. residents who are at least 18 years of age or the legal age of majority in their jurisdiction. By using the Site, you represent that you meet this requirement.

6. LICENSE TO USE THE SITE  

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, subject to the Agreement.

7. INTELLECTUAL-PROPERTY RIGHTS  

All Content and Services are owned by CoverLand Brokerage or its licensors and protected under U.S. and international intellectual-property laws. Except as expressly permitted, no Content may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed without our prior written consent.

8. INSURANCE-INFORMATION DISCLAIMER  

Coverage descriptions on the Site are summaries only and are not contracts, binders, or policies of insurance. Product availability and pricing vary by carrier, underwriting guidelines, and state law. Final terms are governed solely by the policy documents issued by the insurer.

9. NO PROFESSIONAL ADVICE  

The Site provides general information. It does not provide legal, tax, investment, or other professional advice. Always consult qualified professionals about your specific situation.

10. GEOGRAPHIC & REGULATORY RESTRICTIONS  

CoverLand Brokerage is licensed as an insurance producer in the jurisdictions in which it conducts business. Nothing on the Site constitutes a solicitation to buy or sell any product in any jurisdiction where such offer would be unlawful.

11. REGULATORY DISCLOSURES  

We may receive commissions or other compensation from insurers for policies placed. Additional producer-compensation disclosures, if required by law, will be furnished upon request.

12. USER ACCOUNTS & SECURITY  

You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

13. USER-SUPPLIED CONTENT  

By submitting questions, reviews, testimonials, forms, or other content, you grant CoverLand Brokerage a perpetual, worldwide, royalty-free license to use, reproduce, display, and distribute such content in any media. You represent that you have all rights necessary for such submission.

14. PROHIBITED USES  

You agree not to:  

a. Violate any law or regulation;  

b. Attempt to gain unauthorized access to the Site or its systems;  

c. Scrape, crawl, or harvest data;  

d. Transmit viruses or malicious code;  

e. Use the Site to advertise or solicit without our prior consent.

15. THIRD-PARTY LINKS & CONTENT  

The Site may contain links to third-party websites or resources. We are not responsible for their content, products, or practices. Access them at your own risk.

16. TESTIMONIALS & REVIEWS  

Individual results may vary. Testimonials are the opinions of the clients who provided them and do not guarantee similar outcomes.

17. QUOTING TOOLS & CALCULATORS  

Estimates generated by any quoting engine or calculator are non-binding indications based on the information you supply and insurer-filed rates. Coverage is not effective until confirmed in writing by the carrier.

18. SMS/MMS MESSAGING TERMS  

When you opt in, you agree to our Messaging Terms & Conditions, including:  

• Message frequency varies; message and data rates may apply.

You consent to receive communications from us electronically and agree that all notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing.

21. DISCLAIMER OF WARRANTIES  

THE SITE, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

22. LIMITATION OF LIABILITY  

TO THE FULLEST EXTENT PERMITTED BY LAW, COVERLAND BROKERAGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US, WHICHEVER IS GREATER.

23. INDEMNIFICATION  

You agree to indemnify and hold harmless CoverLand Brokerage from and against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of the Agreement or misuse of the Site.

24. DISPUTE RESOLUTION — BINDING ARBITRATION  

Any dispute arising under the Agreement shall be resolved by binding arbitration in Suffolk County, New York, under the Commercial Arbitration Rules of the American Arbitration Association. You waive the right to participate in any class action.

25. GOVERNING LAW & JURISDICTION  

The Agreement is governed by the laws of the State of New York, without regard to its conflict-of-law provisions. Subject to Section 24, any lawsuit shall be filed exclusively in the state or federal courts located in Suffolk County, New York.

26. SEVERABILITY  

If any provision of the Agreement is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.

27. ASSIGNMENT  

You may not assign or transfer your rights or obligations under the Agreement without our prior written consent. We may assign the Agreement without restriction.

28. ENTIRE AGREEMENT & WAIVER  

The Agreement constitutes the entire agreement between you and us regarding the Site and supersedes all prior or contemporaneous agreements. Failure to enforce any provision is not a waiver of that provision.
